Tenant rights in India

India's tenant rights are governed primarily by the Transfer of Property Act 1882 and the Model Tenancy Act 2021, with individual states having their own Rent Control Acts. Here's what every tenant in India should know.

Eviction rights

  • Your landlord must give you a minimum of 15 days written notice before eviction under the Model Tenancy Act 2021.
  • Eviction without a court order is illegal. Your landlord cannot physically remove you or your belongings without going through the legal process.
  • Common legal grounds for eviction include non-payment of rent, subletting without permission, or using the property for illegal purposes.
  • If you receive an eviction notice, you have the right to challenge it before the Rent Authority.
  • Forceful eviction constitutes criminal trespass under IPC Section 441 and can be reported to police.

Security deposit

  • Under the Model Tenancy Act 2021, security deposits are capped at 2 months rent for residential properties.
  • Your landlord must return your deposit within 1 month of you vacating the property, less any legitimate deductions.
  • Deductions must be itemised and supported with evidence — your landlord cannot simply keep your deposit.
  • If your deposit exceeds 2 months rent, the excess amount was collected unlawfully.
  • Always get a signed receipt when paying your deposit.

Right to habitable conditions

  • Your landlord is legally required to maintain the property in a habitable condition.
  • Essential services like water, electricity, and sanitation cannot be cut off by your landlord as a form of pressure.
  • If your landlord refuses to carry out urgent repairs, you can approach the Rent Authority.
  • Document all repair requests in writing (text, email, WhatsApp) and keep records.

Privacy and landlord entry

  • Your landlord must give you advance notice before entering the property.
  • Unannounced entry is a violation of your right to peaceful enjoyment of the property.
  • You can refuse entry if proper notice was not given, except in genuine emergencies.

Rent increases

  • Rent increases must be agreed upon in writing and follow what is stated in your tenancy agreement.
  • Many states have Rent Control Acts that limit how much rent can be increased.
  • You cannot be evicted for refusing an unlawful rent increase.
